Terms & Conditions

These terms and conditions apply to the Unqualified app for mobile devices, together with any related services operated by Vinay Bomma (collectively, the "Application"). Vinay Bomma is hereby referred to as the "Service Provider".

By downloading or using the Application, you agree to these Terms and Conditions. You should read them carefully before using the Application.

Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device for personal or internal business purposes. You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except to the extent expressly permitted by applicable law.

The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding. Nothing in these Terms grants you a license or right to use the Service Provider's trademarks, logos, or branding.

The Application may offer purchases that unlock additional simulation access. Prices, available packages, and purchase terms are presented in the Application or applicable app store before purchase. Purchases are processed by the applicable app store and the Service Provider's purchase provider. Refunds are subject to the policies of the relevant app store, except where applicable law provides otherwise.

You agree not to misuse the Application, interfere with its operation, attempt to bypass purchase or access controls, infringe intellectual property rights, or use the Application in violation of applicable law.

The Service Provider may suspend or terminate access to the Application if you materially breach these Terms, violate applicable law, infringe intellectual property rights, or engage in activity that could cause harm to the Service Provider or others. Upon termination, your right to use the Application ends and you must delete all copies from your devices.

The Application uses third-party services that have their own terms and conditions:

• Expo
• RevenueCat
• PostHog
• OneSignal

To the fullest extent permitted by law, the Service Provider shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption. Nothing in these Terms limits liability that cannot lawfully be excluded or limited.

These Terms are governed by the laws of the jurisdiction in which the Service Provider is established, excluding conflict of law rules, except to the extent mandatory consumer protection laws provide otherwise. Nothing in this clause limits rights you may have under mandatory law.

The Service Provider may update these Terms from time to time. Changes will be posted here with an updated effective date. Previous versions will be made available upon request by contacting itsvinaybomma@gmail.com.
